These terms
These terms are an agreement between you and Swell Games, TOO. They apply when you download or use Sleepful. If you do not accept them, do not use the app.
Your licence to the app itself is Apple's standard Licensed Application End User Licence Agreement, which you accept through the App Store. These terms sit alongside it and cover everything else: the subscription, what the app does and does not promise, and our responsibility to you. Apple is not a party to these terms, but Apple sells the subscription, takes the payment and handles refunds.
Your licence
You get a personal, non-transferable licence to use Sleepful on Apple devices you own or control, on the terms Apple's Usage Rules set. You may not sell, sublicense or redistribute the app, and you may not reverse-engineer it except where the law allows it anyway.
Sleepful — the app, its name, its design and the models inside it — stays ours. Your recordings and the nights the app produces stay yours; we only process them on your device to give you the app.
Subscription and free trial
Sleepful is sold as one annual auto-renewing subscription with a 7-day free trial. The App Store shows the price for your country before you buy, so we do not quote it here.
Unless you cancel at least 24 hours before the trial ends, it becomes a paid year and Apple charges your Apple Account. Each year renews the same way, at the price Apple shows at the time, until you cancel.
Cancelling
Cancel at any time: Settings › your name › Subscriptions on your iPhone, or the manage-subscriptions sheet inside Sleepful. Cancelling stops the next charge — you keep Sleepful until the period you have paid for ends. Deleting the app does not cancel the subscription.
Refunds
Apple takes the payment, so Apple issues refunds; we are not able to. Ask at reportaproblem.apple.com. Our refund page explains the steps. If you are owed a refund under the consumer law where you live and Apple's process does not resolve it, write to support@getsleepful.app and we will deal with it.
If you live in the EU or EEA
You have 14 days from the day you subscribe to withdraw from the contract without giving a reason, and we do not ask you to give that right up. Send a withdrawal request through Apple's refund process, or to support@getsleepful.app if that does not work.
Sleepful is not a medical device
Sleepful is for information and general wellbeing. It is not a medical device, it is not certified as one, and nothing it shows is medical advice, a diagnosis or a treatment. It estimates your sleep from the sound in your room, and those estimates can be wrong.
Do not use Sleepful to diagnose or treat anything, and do not change anything about your health or your medication because of what it says. If something worries you — loud snoring, pauses in your breathing, exhaustion during the day — see a doctor.
The alarm is not a guarantee
The smart alarm depends on your iPhone. It has to be switched on, charged, and in a state where iOS will let an alarm ring; iOS, not Sleepful, decides in the end whether and when it sounds. We cannot promise the alarm will ring, ring on time, or wake you.
Keep a separate alarm you trust for anything that matters, and do not rely on Sleepful where being woken is a matter of safety.
Recording, and other people in the room
Sleepful records audio while you sleep and analyses it on your iPhone. Recordings and clips stay on the device unless you turn on iCloud sync, which stores your nights in your own private iCloud database. We do not receive them.
Tell anyone who sleeps in the room that the app is recording, and do not run it where recording people is not allowed. The Privacy Policy has the detail.
Third-party services
Apple runs the App Store, the billing and iCloud. RevenueCat manages subscription entitlements for us. The Meta SDK measures whether our ads lead to installs and subscriptions. What each one receives is set out in the Privacy Policy.
Using the app properly
Use Sleepful for yourself and lawfully. Do not work around its licence checks, do not use it to record people who have not agreed to it, and do not resell access to it.
Age
You must be 16 or older to use Sleepful. If you are under 18, a parent or guardian must agree to these terms on your behalf.
No warranty
Sleepful is provided as it is. Beyond what the law requires of us, we do not promise that it will be uninterrupted, free of errors, or accurate for you in particular.
Our liability
We are responsible for loss we cause you by breaking these terms or by failing to use reasonable care. We are not responsible for indirect or consequential loss — a missed appointment, missed work, or anything else that follows an alarm that did not wake you. Where a limit is allowed, our total liability is capped at what you paid for the subscription in the 12 months before the claim.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer in the EU, the United Kingdom, Australia or anywhere else whose consumer law gives you rights that cannot be excluded, those rights stand in full and nothing in these terms reduces them.
Changes
We may change the app and these terms. If a change matters to you we will say so in the app or on this page before it takes effect, and the date at the top of this page always marks the current version. Using Sleepful after a change means you accept it.
Ending this agreement
You can end it by cancelling the subscription and deleting the app. We can end it if you break these terms, in which case your licence stops. Ending the agreement does not by itself refund a period already paid for; refunds go through Apple.
Governing law
These terms are governed by the law of the Republic of Kazakhstan, where Swell Games, TOO is registered, and disputes belong to the courts there. If you are a consumer, this does not take away the protection of the mandatory law of the country you live in, and you may also bring a claim in your local courts. Please write to support@getsleepful.app first — almost everything is settled that way.
